Should there be mandatory limits (default limits for time and monetary thresholds) on machines accepting direct cashless payments? The Commission will conduct a future review of the gaming machine technical standards. However, there is no uniformity across land-based machines as a whole. The Gambling (Premises Licence Fees) (England and Wales) Regulations 2007 established the maximum level of fees that local authorities in England and Wales can charge for gambling premises licences. A premises licence is required to operate a non-remote premises-based gambling business. To support their role, licensing authorities collect premises licence fees for applications and annual renewals to cover the cost of administration of their gambling duties and gambling enforcement. As set out in the white paper, we believe that a more precautionary approach is justified for slot-style games which mirror the mechanics of adult-only gaming machines, particularly those which pay out cash. We will give further consideration to these casinos having the option of reverting back to the existing (current) regime, as this will be a decision unavailable to 2005 Act Small casinos. We also acknowledge concerns about an increased availability of machines potentially leading to greater opportunities for gambling-related harm. Feedback from engagement with operators has indicated that the sliding scale as proposed would benefit the majority of casinos, with over 80% of casinos estimated to benefit depending on how floor space is reconfigured. Forty responses were received to this question, with 60% opposed to venues being able to hold multiple licences.
In making this proposal we acknowledge some concerns from industry stakeholders about the necessity of a table gaming area requirement. Forty-two per cent expected a small increase in the supply and availability of other gambling products, while 41% expected either a small decrease or large decrease in the supply of other gambling products. Respondents had differing views on the impact on other gambling products. Contrastingly, respondents from local government, campaign groups and academia were more cautious about any measures which could be seen as increasing the supply of gambling opportunities, due to links between rates of gambling participation and gambling-related harm. We will work with the relevant trade bodies and operators to understand the feasibility of this proposal and the frequency of any reporting to DCMS. This includes ensuring that appropriate safeguards against gambling-related harm are in place.
Application fees for operating licences are determined by the type of activity and the operator’s projected gross gambling yield (GGY) for the first year. On balance, we do not believe that it is proportionate to mandate that ‘cash-out’ Category D slot-style machines be moved to age-restricted areas. The majority of these responses came from industry operators. Twenty-two per cent of respondents stated that these machines should not be placed in age-restricted areas. The rationale most commonly expressed for the movement of these machines into age-restricted areas was to increase the effectiveness of staff monitoring.
Based on the responses to the consultation, DCMS introduced changes that would allow casinos that were already operating when the Gambling Act 2005 (the Act) came into force, to access a number of new entitlements if certain conditions were met. It requires remote gambling operators selling into the British market, whether based here or abroad, to hold a Commission licence to enable them to transact with British consumers. Casinos with multiple licences at the same physical location could site more than 80 machines under the new regime – it is not clear whether the current rules are clear enough to prevent this situation from arising in practice. It is our intention that these casinos can continue to operate under the existing regime, whereby they are permitted no more than 20 machines where at least one is of Category B (or they may elect to have any number of Category C or D machines instead). Each should have its own casino premises licence and its own principal entrance from a street, and it must not be possible to enter one of them from other gambling premises. Part 1 of Schedule 1 to the Gambling Act 2005 (Mandatory and Default Conditions) (England and Wales) Regulations 2007 sets out a number of mandatory conditions that are attached to all casino premises licences. Currently, a number of 1968 Act casinos operate more than one premises licence at the same physical location.
